TERMS OF SERVICE
Last updated: October 7, 2026
1. Who we are and when these Terms apply
These Terms of Service ("Terms") are an agreement between you and New Chapter Marketing LLC ("Epic Marketing Events," "we," "us") about epicmarketingevents.com and the products, software, events and services we provide through it (the "Services").
These Terms become a binding agreement when you affirmatively accept them, for example by checking a box or clicking a button next to a statement that you agree to these Terms when you create an account, register, or make a purchase ("Customers"). Simply visiting or browsing our website does not by itself make you a party to these Terms. Visitors who have not accepted these Terms are still welcome to read our website, and our Privacy Policy explains how we handle information from all visitors.
2. Eligibility
You must be at least 18 years old to create an account or buy from us.
3. Accounts
You are responsible for the accuracy of the information you give us and for keeping your login details secure. Tell us promptly at zach@epicmarketingevents.com if you believe your account has been accessed without permission.
4. Purchases, billing and renewals
Prices and what is included are shown at checkout. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time and the cancellation takes effect at the end of the current billing period. Payments are processed by our payment processors; we do not store full card numbers.
5. Refunds and cancellations
6.1 Event tickets are non refundable
All event ticket sales are final. We do not issue refunds on event tickets, in whole or in part, for any reason, including inability to attend, travel disruption, illness, visa or immigration delays, work conflict, or change of mind.
Event tickets are non refundable because we commit to venue, catering, staffing, production, and hospitality costs in advance on the basis of confirmed registrations, and those commitments cannot be recovered once made.
This policy is disclosed on the checkout page and must be accepted before purchase is completed.
6.2 You may transfer your ticket
Although tickets are non refundable, they are transferable. You may transfer your ticket to another person at no charge by emailing zach@epicmarketingsummit.com at least 7 calendar days before the first day of the event with:
- your name and order number,
- the full name, email address, and phone number of the new attendee.
We will confirm the transfer by email within 5 business days. One transfer per ticket. Transfers requested inside 7 days before the event are handled at our discretion and may be declined for badge production and catering reasons.
6.3 Credit toward a future event
If you cannot attend and cannot find a replacement attendee, you may request, in writing at least 30 calendar days before the event, a credit for the amount you paid toward a ticket to our next comparable event held within 12 months. Credit is issued at our discretion, is not redeemable for cash, is non transferable, and expires if unused at that next event. This is a courtesy and is not a refund.
6.4 Cancellation by you
You may cancel your registration at any time by emailing zach@epicmarketingsummit.com. Cancellation releases your seat but does not entitle you to a refund of amounts paid, and it does not cancel any remaining installments owed under Section 5 or any obligation to a third party financing provider.
6.5 Cancellation, postponement, or relocation by us
If we cancel an event outright and do not reschedule it, we will refund 100 percent of the ticket price you paid, to the original payment method, within 30 calendar days of the cancellation announcement.
If we postpone, reschedule, or relocate an event, your ticket automatically transfers to the new date or venue at no additional cost. If you cannot attend the new date, you may, within 14 calendar days of our announcement, elect either to transfer your ticket to another person under Section 6.2 or to receive a credit under Section 6.3.
If an event is disrupted or made impracticable by causes outside our reasonable control, including acts of God, severe weather, fire, flood, epidemic or pandemic, public health order, act of terrorism, war, civil disorder, labor dispute, venue closure, or failure of utilities or transport infrastructure, we may reschedule the event, relocate it, or deliver it in a virtual format. In that case we will provide the alternative described above rather than a cash refund, to the extent permitted by law.
6.6 Digital products, recordings, and courses
Digital products, including event recordings, courses, training programs, templates, and downloadable materials, are delivered immediately or on the stated release date. All sales of digital products are final and non refundable once access has been delivered, because the product is consumed on delivery.
Where we are unable to deliver a digital product you paid for, we will either restore access or refund that product in full.
6.7 Subscriptions and memberships
Where a product is sold as a recurring subscription, the renewal date and amount are shown at checkout. You may cancel a subscription at any time before the next renewal date by emailing zach@epicmarketingsummit.com or using the cancellation link in your receipt. Cancellation stops future charges. Amounts already charged for the current or prior billing periods are not refundable, and access continues to the end of the period you paid for.
6.8 How to make a request
Send all refund, transfer, credit, and cancellation requests to zach@epicmarketingsummit.com with your full name, order number, purchase date, and the reason for the request. We acknowledge every request within 2 business days and issue a written decision within 5 business days. Approved refunds are returned to the original payment method within 10 business days of approval, and the time it takes your bank or card issuer to post the credit is outside our control.
6.9 Errors and duplicate charges
If you were charged in error, charged twice, or charged an incorrect amount, contact us within 60 days of the charge and we will investigate and correct it, including a full refund of any amount charged in error. This applies regardless of Sections 6.1 and 6.6.
6.10 Chargebacks
If you believe a charge is incorrect, contact us first at zach@epicmarketingsummit.com. We will work with you in good faith to resolve it. Initiating a chargeback or payment dispute without first contacting us is a breach of this Agreement. Where a chargeback is filed on a valid purchase, we may void the associated ticket or product access, decline future purchases, and recover the disputed amount and any related fees, and we will supply the payment provider with your acceptance of this Agreement, your order record, and your delivery or attendance record.
6.11 Statutory rights
Nothing in this Section limits any right you have under applicable consumer protection law that cannot be waived by agreement.
6. Acceptable use
You agree not to: break the law or infringe anyone's rights using the Services; upload malicious code or attempt to access systems or data you are not authorized to access; scrape, copy or resell the Services or their content without our written permission; share account access outside the plan you bought; or use the Services to send spam or unlawful messages.
7. Your content
You keep ownership of content you submit. You give us a limited license to host, process and display it only as needed to provide the Services to you.
8. AI-generated output
Some Services use artificial intelligence. AI output can be inaccurate or incomplete. You are responsible for reviewing output before you rely on it or publish it.
9. Results and earnings
Examples of results, revenue or earnings shown on our website or in our materials are not typical and are not a promise or guarantee of what you will achieve. Your results depend on your own effort, skill, market and many other factors.
10. Affiliate links and third-party services
Some links on our website are affiliate links, which means we may earn a commission if you buy through them, at no extra cost to you. Third-party products and services are governed by their own terms and privacy policies, and we are not responsible for them.
11. Intellectual property
The Services, including our software, content, designs, trademarks and training materials, belong to us or our licensors. Purchasing gives you a personal, non-transferable license to use them for their intended purpose under these Terms.
12. SMS terms
By purchasing from us or opting in on our websites, you consent to receive transactional messages about your order and the event, which are required and cannot be opted out of while your order is active, and marketing messages by email and, where you provided a mobile number and consented, by SMS. You may unsubscribe from marketing messages at any time using the link in any marketing email or by replying STOP to any marketing SMS. Message and data rates may apply.
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 IF YOU PAID NOTHING. Some jurisdictions do not allow these limits, so they apply to you only to the extent the law allows.
15. Termination
You may stop using the Services at any time. We may suspend or end your access if you materially breach these Terms. Sections that by their nature should survive (including 7 through 19) survive termination.
16. Resolving disputes: informal resolution first
Most concerns can be fixed quickly. Before starting any arbitration or court case, you and we each agree to first send a written Notice of Dispute and try in good faith to resolve it for 60 days. A Notice from you must be sent to zach@epicmarketingevents.com with the subject "Notice of Dispute" and must include your name, the email address associated with your account or purchase, a description of the dispute, and the relief you want, and it must be personally signed by you (not only by a lawyer or representative). A Notice from us will go to the email address on your account. Any statute of limitations is paused while this process is underway.
17. Arbitration agreement and class action waiver (Customers only)
This Section applies only to Customers who accepted these Terms as described in Section 1.
(a) Binding individual arbitration. If a dispute is not resolved under Section 16, it will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you used the Services for business purposes. The Federal Arbitration Act governs this Section. Hearings will take place by video or telephone unless the arbitrator decides an in-person hearing is necessary, in which case it will take place in New York County, New York, or another location agreed by both parties.
(b) Small claims. Either party may instead bring an individual claim in small claims court if it qualifies.
(c) No class or representative actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may award relief only to the individual party seeking it.
(d) Multiple similar claims. If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules (or its then-current rules for multiple case filings). Demands may be grouped into batches for administrative efficiency only. The outcome of one arbitration does not bind any other claimant. Each demand remains subject to the informal resolution section above, and all statutes of limitations and filing deadlines are paused for every claimant while their demand is waiting to be processed.
(e) Fees. Filing, administration and arbitrator fees are paid as provided in the applicable AAA rules.
(f) 30-day opt-out. You may opt out of this arbitration agreement by emailing zach@epicmarketingevents.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
(g) Severability. If the class action waiver in (c) is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court under Section 18, and the rest of this Section continues to apply.
18. Governing law and courts
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict of law rules. For any matter not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
19. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date and, for material changes, notify Customers by email or in the Services. Changes apply going forward only and never to a dispute that arose before the change. If you do not agree to an update, you may stop using the Services and cancel.
